SHARE St Albans Terms and Conditions

Introduction

Thank you for signing up to use SHARE St Albans Library of Things. SHARE St Albans is an enterprise set up and operated by The Green House St Albans CIC.  Before you can hire from us, we need you to agree to these Terms and Conditions (the “Terms”). These keep us all safe and ensure a good service for everyone and also ensure that we know what to expect from each other.  

Definitions

‘Hiring’ – the act of hiring an item from our Library of Things for the stated fees and returning it on the stated return date.

‘Item’ – any piece of equipment or other item stocked by SHARE St Albans.

‘Member’ – any person who has created an account via the SHARE St Albans website, regardless of whether they have hired or not.

‘SHARE St Albans’ or ‘LoT’ (or ‘us’, ‘we’ or ‘our’) – The library of things, operated by The Green House St Albans CIC, hiring out Items to Members.  Where the term SHARE St Albans (or ‘LoT’ (or ‘us’, ‘we’ or ‘our’)) is used in these Terms it includes a reference to The Green House St Albans CIC. 

Joining & Membership

Only Members are able to hire from the LoT. To become a Member, you must:

Be aged 18 or above, and provide proof of ID. If you’re registering online, you must bring in your ID the first time you borrow an item. If you’re joining in person, please have it ready for when you come in, even if you think we know you. 

Proof of address, this could be your driver’s licence, a letter from the bank, the council, or utility supplier. If you’re joining online, you must bring  in your proof of address the first time you borrow an item. If you’re joining in person, please have it ready for when you come in. 

Provide your personal details including full name, current postcode, valid phone number and a valid email address so that we can contact you.

Tick the box on our platform to accept these Terms.

Your Responsibilities

We are a social enterprise, run by volunteers who really want our community to have a great library of things. We operate on shared values of communication, honesty, and trust. A lot of this might feel obvious, but as a member you agree to:

Bring the item back clean. If the item is returned in a state that means our team need to clean it, we reserve the right to charge for our time.

Bring the item back on time, so the next Member isn’t kept waiting. You must return all items in their complete state (i.e. with all included parts) by closing time on the stated return date, as per your emailed check-out receipt. If you need to change your return date, please contact us before closing time on the return date so we can advise you if someone else has reserved it. You understand that returning items after their return date will incur a Late Fee, of at least £1 per day, depending on item value. 

Bring the item back with all its parts in good working order, so that it’s ready for use by the next Member. We understand that accidents happen but you should understand that If you return an item damaged beyond what is normal wear and tear and/or reasonable use, you agree to repair the damage (and restore it to its state at the time you picked it up) or replace the item. You agree to accept our assessment of the condition of the damaged item, and judgement of the appropriate remedy for such damage.

Tell us about any accidental damage immediately so we can plan for the next Member. We will not charge you for ‘reasonable use’ wear and tear, but please do point it out to us on return and see above regarding damage beyond normal wear and tear and reasonable use.

Keep the Item safe. If you have a problem returning the Item, please contact us immediately. If you lose it or the Item is stolen from you, you agree to replace the item or provide sufficient funds for us to be able to do so. 

Use the Items in a safe and proper manner. You are responsible for using any Item you hire for the job it is intended to do, taking appropriate safety precautions outlined in how-to guides, including learning how to use the Item, inspection to ensure it is safe before use, wearing appropriate personal protective equipment (PPE), and immediately stopping use of an Item if it becomes unsafe or damaged. 

Pay the total amount owed for the Item(s) hired. We will charge you the hiring fee at the time you pick up the items from us.

Our responsibilities 

We can change or cancel a booking if we need to. If this happens, we will let you know what the change is and the reason for it as soon as reasonably possible. We can also refund any borrowing fee you have already paid in the event we cancel the booking or you wish to cancel the booking following the change.

We will store and process your personal data in compliance with the UK General Data Protection Regulation (GDPR) and other data protection laws. A copy of our privacy notice is available on our website.

We do not guarantee that any particular item will be available at any particular time. If we think it’s important to keep the LoT working smoothly, we can remove any item from the library of things, limit the number of things borrowed by one member, refuse the loan of any item, or refuse a request for membership.

We are learning as we go, and we may find ways to improve our processes. We may change these terms and conditions at any time, but we’ll let you know when we do, and you’ll get a chance to cancel your membership (membership fee is non-refundable) if you don’t accept the changes to these terms. We will assume that by continuing to be a member, you have accepted the changes to our termsand conditions.

We will be liable for any loss or damage caused by our negligence, but we will not be responsible to you for any losses or damages which are not reasonably foreseeable by us at the relevant time, or any events beyond our reasonable control. We also have no liability for any loss of profit, loss of business or business opportunities, even if you choose to use the item for any commercial purpose. We of course do not exclude liability for any death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation or any other liability that cannot be excluded under applicable law.

General Legal Provisions

These Terms form the entire agreement between us and you in relation to your membership of the LoT.

If we choose to delay our rights under these Terms, or not enforce them, this does not mean that we have waived these rights nor that you do not have to comply with any of those requirements.

If any paragraph or part of these Terms are found to be unenforceable, this does not affect the validity of any other paragraphs or parts.

These Terms are between you and us and cannot be relied on by anyone who is not a party to them. No third party has the right to enforce these terms under the Contract (Rights of Third Parties) Act 1999 or otherwise. You may not transfer any of your rights or obligations under these terms.

These Terms, and any dispute or claim (including non-contractual disputes or claims) that arise from or in connection with borrowing from the LoT, or these terms, will be governed by the law of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales.
